REDWOOD CITY -- The judge in Scott Peterson’s murder trial removed one of the 12 jurors this morning and denied a defense motion for a mistrial.
After being dismissed, Justin Falconer, who had been Juror No. 5, issued a pointed critique of the prosecution’s case to date, calling one witness “a joke” and saying prosecutor Rick Distaso bounced around too much in his questioning.
“It’s difficult to follow what he’s saying,” Falconer said. “I’m not getting a story out of him.”
